MOMMYBAG
These Terms and Conditions set out the rules for using the online store mommybag.pl, placing orders, concluding sales contracts, delivery, payment, withdrawal from the contract, and complaints. Please read the following provisions carefully before making a purchase.

§1. GENERAL PROVISIONS
1.1. The online store available at mommybag.pl is operated by:

1.4. The Store conducts retail sales of products via the Internet within Poland and selected countries of the European Union.
1.5. These Terms and Conditions constitute an integral part of the sales contract concluded between the Customer and the Seller.
1.6. Placing an order requires prior reading and acceptance of these Terms and Conditions during the checkout process.
§2. DEFINITIONS
Store — the online store operated by the Seller, available at mommybag.pl.
Seller — SZUUUS Sp. z o.o. with its registered office in Mińsk Mazowiecki, ul. Józefa Mireckiego 13A/7, 05-300 Mińsk Mazowiecki, NIP: 8222408059, KRS: 0001099349.
Customer — a natural person with full legal capacity, a legal person, or an organizational unit without legal personality, who makes or intends to make a purchase in the Store.
Consumer — a Customer who is a natural person entering into a legal transaction (purchase) with the Seller not directly related to their business or professional activity.
Entrepreneur with consumer rights — a natural person running a sole proprietorship, entering into a contract directly related to their business activity, where the contract is not of a professional nature for that person.
Product — a movable item offered by the Seller through the Store and constituting the subject of the sales contract.
Order — a declaration of intent by the Customer aimed at concluding a sales contract for a Product with the Seller, submitted through the Store.
Sales contract — the contract for the sale of a Product concluded between the Customer and the Seller through the Store.
Business day — any day from Monday to Friday, excluding public holidays in Poland.
§3. TECHNICAL REQUIREMENTS
3.1. To use the Store, including browsing the assortment and placing orders, the following are required:
3.2. The Customer is obliged to use the Store in a manner consistent with the law and good practices, with respect for personal rights and intellectual property rights of third parties. It is prohibited to provide unlawful content.
§4. PLACING ORDERS
4.1. Orders may be placed via the website mommybag.pl 24 hours a day, 7 days a week.
4.2. Registration of a customer account in the Store is not required. The Customer may make a purchase as a guest by providing the data necessary to complete the order.
4.3. Order placement procedure:
Step 1: Select a Product and click “Add to cart”. Step 2: Go to the cart and click “Proceed to checkout”. Step 3: Enter shipping details (first name, last name, address, phone number, e-mail). Step 4: Choose the payment method. Step 5: Read these Terms and Conditions and accept them. Step 6: Click the “Buy and pay” button — this constitutes an order with an obligation to pay.
4.4. After placing the order, the Customer receives an automatic confirmation of receipt by e-mail, containing: the order number, list of ordered Products, price, selected payment and delivery method, and shipping details.
4.5. The sales contract is concluded when the Customer receives the order confirmation referred to in point 4.4.
4.6. The Seller reserves the right to refuse execution of an order or part of it in the event of: lack of Product availability in stock, incorrect or incomplete data provided by the Customer, or inability to contact the Customer. In such a case, the Seller shall promptly inform the Customer and refund any payments made.
§5. PRICES AND PAYMENTS
5.1. All Product prices in the Store are gross prices (including VAT 23%) and are expressed in Polish zloty (PLN) for orders within Poland and in EUR for other countries where sales are conducted.
5.2. The Product price displayed on the website at the time of placing the order is binding for both the Customer and the Seller.
5.3. Delivery is free of charge. The Seller does not charge any additional shipping costs, handling fees, or other hidden fees.
5.4. Available payment method:
5.5. Order processing begins after the payment has been credited to the Seller’s bank account.
5.6. A VAT invoice is issued for each order and sent to the Customer’s e-mail address after the order has been processed. A Customer wishing to receive an invoice for a company should provide company details (NIP, company name, address) during the checkout process.
§6. DELIVERY
6.1. Orders are shipped by courier, depending on the destination country: InPost (Poland), DHL.de (Germany, France), CTT Express (Spain), DHL.nl (Netherlands), PostNL (Denmark), DPD (Austria), Italian Post (Italy).
6.2. Delivery cost: free of charge for all orders.
6.3. Order processing time:
6.4. The Seller delivers to the following countries:
6.5. After dispatch of the shipment, the Customer receives an e-mail with the tracking number, allowing the delivery status to be tracked.
6.6. Orders placed on Saturdays, Sundays, and public holidays are processed on the nearest business day.
6.7. It is recommended to check the condition of the shipment in the presence of the courier. In the event of visible mechanical damage to the packaging, a damage report should be prepared with the courier and the Seller should be contacted immediately.
§7. RIGHT OF WITHDRAWAL
7.1. A Consumer and an Entrepreneur with consumer rights has the right to withdraw from a distance contract within 14 days without giving any reason.
7.2. The withdrawal period expires 14 days after the day on which the Customer or a third party indicated by them, other than the carrier, acquired possession of the Product.
7.3. To exercise the right of withdrawal, the Customer must inform the Seller of their decision by means of an unequivocal statement (for example, a letter sent by post or e-mail). The Customer may use the withdrawal form available in the footer of the Store website and included with each order, but this is not mandatory.
7.4. The withdrawal statement should be sent:
7.5. To meet the deadline, it is sufficient to send the statement before the withdrawal period expires.
7.6. The Seller shall promptly confirm receipt of the withdrawal statement by e-mail.
7.7. The Customer is obliged to return the Product to the Seller without undue delay, but no later than 14 days from the day on which they informed the Seller about withdrawal from the contract. The deadline is met if the Customer sends back the Product before the 14-day period expires.
7.8. The Product should be sent back to the warehouse address:

7.9. The cost of returning the Product is borne by the Seller. The return is free of charge, and detailed return shipping instructions are provided by the Seller’s customer service.
7.10. The Seller shall refund the Customer all payments received, including delivery costs (if charged), within 5 business days from the date of receiving the returned Product. The Seller shall refund the payment using the same payment method used by the Consumer, unless the Consumer expressly agrees to a different refund method that does not involve any costs for them.
7.11. The Customer is liable for any diminished value of the Product resulting from handling it in a way other than what is necessary to establish its nature, characteristics, and functioning.
7.12. The right of withdrawal does not apply to contracts (pursuant to Article 38 of the Consumer Rights Act):
§8. COMPLAINTS (NON-CONFORMITY OF GOODS WITH THE CONTRACT)
8.1. The Seller is obliged to deliver a Product to the Customer that is free from defects and in conformity with the contract.
8.2. The Seller is liable for any non-conformity of the Product with the contract existing at the time of delivery and disclosed within 2 years from that time.
8.3. If the non-conformity of the Product with the contract becomes apparent within 2 years of delivery, it is presumed to have existed at the time of delivery.
8.4. A Product is non-conforming with the contract in particular when it:
8.5. In the event of non-conformity of the Product with the contract, the Customer may request:
a) first of all: repair of the Product or replacement of the Product with a new one
b) if repair or replacement is impossible or would involve excessive costs: price reduction or withdrawal from the contract (in the case of a substantial defect)
8.6. A complaint may be submitted:
8.7. The complaint should contain: Customer details, order number, description of the non-conformity (defect), the Customer’s request (repair, replacement, price reduction, withdrawal from the contract). It is recommended to attach photos showing the defect.
8.8. The Seller shall examine the complaint within 14 calendar days from the date of receipt and inform the Customer of the outcome.
8.9. If the Seller does not respond to the complaint within 14 days, the complaint is deemed accepted.
8.10. The complained Product should be sent to the warehouse address after receiving instructions from the Seller:

8.11. In the event of an accepted complaint, the Seller covers the costs of sending the complained Product. A refund (in the event of a price reduction or withdrawal from the contract) will be made within 5 business days from the examination of the complaint.
§9. WARRANTY
9.1. All Products offered in the Store are covered by a 24-month warranty granted by the Seller.
9.2. The warranty covers manufacturing and material defects of the Product.
9.3. Warranty claims should be submitted to the following e-mail address: info@mommybag.pl.
9.4. The warranty does not exclude, limit, or suspend the Customer’s rights arising from statutory provisions on non-conformity of goods with the contract. The Customer may, at their choice, pursue claims under the warranty or under statutory non-conformity rules.
§10. ENTREPRENEUR WITH CONSUMER RIGHTS
10.1. A natural person running a sole proprietorship who concludes a contract directly related to their business activity, but not of a professional nature for them, benefits from consumer protection with regard to:

§11. ELECTRONIC SERVICES
11.1. The Seller provides the following electronic services through the Store:
11.2. Electronic services are provided free of charge.
11.3. The agreement for the provision of the electronic service consisting of browsing the Store is concluded for an indefinite period and is terminated when the Customer leaves the Store website.
11.4. Complaints regarding electronic services may be submitted to the following e-mail address: info@mommybag.pl. The Seller shall examine the complaint within 14 days.
§12. PERSONAL DATA
12.1. The controller of Customers’ personal data is SZUUUS Sp. z o.o. with its registered office in Mińsk Mazowiecki.
12.2. Personal data are processed for the purposes of order fulfillment, handling returns and complaints, issuing invoices, and for purposes arising from the legitimate interests of the Controller.
12.3. Detailed information regarding personal data processing, including purposes, legal bases, retention periods, Customer rights, and information about data recipients, is contained in the Privacy Policy available on the Store website.

§13. OUT-OF-COURT DISPUTE RESOLUTION
13.1. A Consumer may use out-of-court methods of handling complaints and pursuing claims.
13.2. The European Union Online Dispute Resolution (ODR) platform is available at: https://consumer-redress.ec.europa.eu. The platform is intended for resolving disputes between consumers and traders concerning online purchases.
13.3. A Consumer may seek assistance from a municipal or district consumer ombudsman.
13.4. Detailed information on out-of-court dispute resolution is available on the website of the Polish Office of Competition and Consumer Protection.
§14. FINAL PROVISIONS
14.1. These Terms and Conditions are governed by Polish law. In matters not regulated herein, the following provisions shall apply:
14.2. The Seller reserves the right to amend these Terms and Conditions for important reasons, in particular in the event of changes in law, changes in payment or delivery methods, or changes in the scope of services provided. Amendments do not affect orders placed before the amendments enter into force.
14.3. The Seller shall inform about any amendment to these Terms and Conditions on the Store website at least 14 days in advance.
14.4. Any disputes with Customers who are not Consumers shall be resolved by the court having jurisdiction over the registered office of the Seller.
14.5. These Terms and Conditions enter into force on the date of publication on the Store website.
